These terms govern your use of Eskeno. By creating an account or using the service, you accept them. Please read them together with our Privacy Policy.
Acceptance of terms
By creating an account or using Eskeno, you agree to these terms. If you do not agree, do not use the service.
Eligibility
You must be at least 16 years old and able to enter into a binding agreement to use Eskeno. By registering, you confirm that you meet these conditions.
Your account
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity that occurs under your account. Notify us of any unauthorized use.
Right to use the service
We grant you a personal, non-transferable and revocable right to use Eskeno for your own training. You may not resell, share or otherwise exploit the service beyond this right.
Acceptable use
You agree not to misuse the service. In particular, you must not use it unlawfully, threaten, harass or abuse others, attempt to disrupt, overload, attack or gain unauthorized access to the service or to other users' accounts, scrape data automatically, or infringe the rights of others.
Your content
You keep ownership of the content you create, such as programs, templates, notes and training data. When you make content available to others through the service, you grant us a non-exclusive, worldwide, royalty-free licence to host it, display it, keep frozen copies of it, and allow other users to take it into their own space and adapt it, as needed to operate the service. This licence survives the closure of your account, but only for content you had already made available, and it cannot be withdrawn for copies others have already taken. Because other users may adapt what you publish, you waive your moral rights in that content to the extent the law allows, including the right to object to its modification and the right to require that your name be associated with it. You are responsible for the content you create and share.
Sharing and visibility
Your account is private by default: your data is hidden from other users. You may choose to publish content (such as exercises, templates and programs) or to share specific information (such as your logs and records) with other users or a circle you define. You are solely responsible for what you make visible and for the consequences of sharing it. By publishing, you represent and warrant that you hold the rights needed for what you share, and you remain responsible if you do not. Do not publish content that is unlawful or that infringes the rights of others. When published content is reported to us as infringing a third party's rights, we may remove it. Information you publish publicly may be seen, used or copied by others. You can unpublish or delete it at any time: it then stops appearing to new users, but copies that other users have already adopted (for example a program or template they are using) remain available to them so their use is not broken. You therefore cannot retroactively remove what others have already adopted.
Intellectual property
Eskeno, its name, its brand and the content we provide in the catalogue (exercises, templates and programs) remain our property or that of our licensors. What is protected is our text, our images and our videos, as well as the structure of the catalogue itself: which exercises we include, how we classify them, and how they are assembled into templates and programs. The movements and training methods themselves belong to no one: you are free to perform and use them. We grant you a personal, non-transferable and revocable right to use the catalogue content for your own training, including copying it into your space and modifying it to suit your needs. You may not resell it, redistribute it outside the service, or extract it in bulk or by automated means, in particular to build a database or to feed a competing service. These restrictions also apply to the public pages of our site, where part of the catalogue can be browsed.
Third-party services
Eskeno lets you sign in with third-party providers (such as Google or Apple) and may link to external sites or services. Those providers and sites have their own terms and privacy policies, which govern your use of them. We are not responsible for third-party services or content, and a link to them is not an endorsement.
Development stage
Eskeno is under active development. Features may change, be added or removed, and the service may contain errors or experience interruptions. We provide it without any guarantee of availability, completeness or fitness for a particular purpose, and we may update it at any time.
Health notice: not medical advice
Eskeno is a training-tracking tool, not a healthcare provider. Its content and automated suggestions are for information only and are not medical advice. Physical training carries inherent risks. Consult a physician or a qualified professional before starting or changing a training program, especially if you have an injury or a health condition. You train at your own risk.
Plans and payment
Eskeno currently offers a free plan. Paid plans and their terms will be described here when they become available. Any change to pricing will be communicated in advance.
Service maintenance and changes
We may develop, maintain, update and migrate the service and the systems that run it. As part of operating it, we may perform technical operations on stored data, such as backups, migrations, backfilling new fields and integrity fixes. We do not change the substance of the content you create, except as needed for these technical operations, to comply with the law, or to enforce these terms.
No warranty
The service is provided "as is" and "as available", without warranty of any kind, whether express or implied. We do not guarantee that it will be uninterrupted, error-free or secure, or that its content and suggestions are accurate or suited to your situation. These exclusions apply to the extent permitted by the law that applies to you. Nothing in this section limits the legal warranty or any other rights you have under consumer protection law, including in Quebec.
Limitation of liability
The service is provided "as is" and "as available". To the extent permitted by the law that applies to you, we are not liable for indirect damages or for losses resulting from your use of the service or from your training. Nothing in these terms limits the rights you have under applicable consumer protection law.
Suspension and enforcement
If you breach these terms or the acceptable-use rules, for example by threatening or harassing others or by attempting to attack or gain unauthorized access to the service, we may warn you, restrict or remove content, suspend your access, or permanently close your account, without notice where necessary to protect the service or other users. Where appropriate, we may report the matter to the competent authorities.
Termination
You may close your account at any time from your settings. We may suspend or close an account that breaches these terms. On deletion, your data is handled as described in the Privacy Policy.
Feedback
If you send us ideas, suggestions or feedback about the service, you grant us the right to use them freely, without any obligation or compensation to you.
Events beyond our control
We are not responsible for any failure or delay caused by events beyond our reasonable control, such as natural disasters, outages, network or hosting failures, or cyberattacks.
Transfer of these terms
You may not transfer your rights or obligations under these terms. We may transfer ours, for example as part of a reorganization, merger or sale, provided your rights under these terms are preserved.
Entire agreement
These terms and our Privacy Policy make up the entire agreement between you and Eskeno regarding the service and replace any earlier agreement on the subject.
Severability
If a provision of these terms is found invalid or unenforceable, the rest remains in effect, and the invalid provision is applied to the fullest extent permitted by law.
Changes to these terms
We may change these terms. The current version and its effective date are shown at the top of this page. We will notify you of significant changes.
Language
These terms are available in French and English. For users in Quebec, the French version prevails.
Governing law
These terms are governed by the laws applicable in Quebec, Canada, and any dispute is subject to the courts of Quebec.
